Any act or use or reference to INQUIZIE, MOBELEASH, INQUIZIE Inc., inquizie.com / mobeleash.com and/or the INQUIZIE / MOBELEASH Websites and/or INQUIZIE / MOBELEASH Apps (hereafter collectively “INQUIZIE”) it’s content including but not limited to Mobile Applications or Apps, content, video, images, information, data, text, software, music, sound, photographs, graphics, messages or other materials (hereafter “content”), by person/s or any entity/ies shall by such act, use and or reference bind such person/s and or entity/ies to all these INQUIZIE Inc. Terms of Use.

Any content, metric and or information provided or conveyed by INQUIZIE is only the subjective opinion of INQUIZIE Inc. Such subjective opinion may indicate general trends only and may not be reliable and or accurate for any purpose. Any act, use or reliance upon such subjective opinions shall subject the user/s to these Terms of Use. INQUIZIE shall not be responsible for the direct and or indirect loss of and device or loss of device content, data, images and any information conveyed by INQUIZIE related to any device possible location, location direction or loss anywhere anytime for any reason. Users hereby agree to hold INQUIZIE, its Owners, Directors, Corporate Officers, Shareholders, Employees and other INQUIZIE users harmless from any and all direct and or any indirect claims of and loss related to device, device data, content or any other direct and or indirect loss. Further, by their purchase of and or use of INQUIZIE assets users shall be bound to hold INQUIZIE Inc., its Owners, Directors, Corporate Officers, Shareholders, Employees and other INQUIZIE users (hereafter “stakeholders”) harmless from any and all liability which may arise anywhere and whatever reason from user’s use and or purchase of an INQUIZIE service, product or asset. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS COLLECTIVELY PLEASE DO NOT USE AND OR REFERENCE INQUIZIE OR ANY INQUIZIE RELATED CONTENT, APPS and or ASSETS.

Let’s be clear, there is little to no Privacy on the Internet; so please make sure any content, including but not limited to any video, images, information, data, content, text, software, music, sound, photographs, graphics, messages or other materials ("content"), that you upload, post, “push”, publish or display (hereinafter, "transmit") or email or otherwise use/upload/send/receive via INQUIZIE you (a.) have the right from the copyright holder to use such content in such manner and (b.) agree to such content becoming instantaneously public knowledge, globally.

By your act of using INQUIZIE you agree to be personally, legally and financially wholly responsible for any content you supply and or retrieve and you agree to abide by all these Terms of Use, to hold INQUIZIE Inc., its stakeholders harmless for any interaction you have with INQUIZIE and or with other INQUIZIE users including but not limited to any content in any format submitted to or received from INQUIZIE anywhere and or on any device. This means that you or your guardian (collectively hereafter “you”) and you alone are personally legally, financially and wholly responsible for anything and or information you get from, contribute to, in any interaction with INQUIZIE and you agree to hold INQUIZIE stakeholders harmless.

INQUIZIE content may be offensive; including but not limited to cursing, insensitive, racist, nude and or violent content. INQUIZIE adheres to the principles and values of freedom of speech, but reserves the unilateral right to remove any content at any time for any reason, including but not limited to any threats or acts of violence, and the user who supplied such removed content shall have no legal and or financial recourse against INQUIZIE or any INQUIZIE Stakeholder. If you do not want to risk being exposed to such content, please do not use INQUIZIE.

INQUIZIE may gather Personal information that you supply where you are required to register/have an account and or use/interact with INQUIZIE; including but not limited to demographic information and Non-personal information collected via technology, which includes, but is not limited to, tracking/geolocation, browser, language, information collected as you use/interact with INQUIZIE. INQUIZIE may use Cookies, Web Beacons or similar tools. INQUIZIE may use third-party vendors including but not limited to Advertisers or Data Centers. INQUIZIE and or INQUIZIE third-party vendors may store information like, but not limited to, IP Addresses, Log Files. Any and all content may be used by INQUIZIE for commercial purposes. INQUIZIE may send communications to you via the information provided and or authentication method used.

Your information may come to INQUIZIE via your Social Media Authentication/Login method, such as Facebook™ or Twitter™ etc.. Your public interaction with INQUIZIE may reveal personal information which when you link or enter such content, instantaneously becomes public. Any such content may be reused by any other person, that is, once you upload content, link to INQUIZIE it becomes instantaneously public and you hereby agree to hold INQUIZIE, its Stakeholders harmless from any and all liability which may result anywhere. Any and all content and or information you get from and or use from INQUIZIE is provided and/or used at your own risk and INQUIZIE makes no warranty as to its accuracy.

Should you create an INQUIZIE account, you alone shall be responsible for the confidentiality of your password and the account. You hereby agree not to disrupt the Service or servers or networks connected to the Service, or disobey any policies or regulations of networks connected to the Service, violate any applicable local, state, national or international law, or any regulations having the force of law, impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity, solicit personal information from anyone under the age of majority and or consent as defined by local law, collect email addresses or other contact information of other users from the Service by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications, advertise or offer to sell or buy any goods or services for any business purpose that is not specifically authorized, assist or promote any criminal activity or enterprise or provide instructional information about illegal activities. You agree to respect any content that is protected by copyright, patent, trademark, trade secret or other proprietary rights and laws.

If the user is not the age of majority and or consent as defined by local law, the user is only authorized to use INQUIZIE with parental/guardian consent. Where the user is under 18 INQUIZIE shall assume that such parental/guardian consent has been granted as it is the sole responsibility of parents/guardian’s to monitor and control their minor children’s internet/internet device access, use and purchases.

When required by law INQUIZIE may disclose personal information or where we have a good faith belief that such action is necessary to comply with the law or with legal process, protect and defend our rights and property, protect against misuse or unauthorized use of INQUIZIE, its assets and or protect the personal safety or property of others.

You agree that you are solely responsible for your interactions with any other user in connection with INQUIZIE, and shall hold INQUIZIE, Inc. and or any of its Stakeholders harmless from any and all liability or responsibility with respect to disputes between you and any other INQUIZIE user and or private/public/governmental entity.

Nothing in these Terms of Use should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any of the INQUIZIE name, logos, trademarks and service marks of INQUIZIE without prior written permission from INQUIZIE, INC. in each instance.

INQUIZIE may at its sole discretion suspend or terminate your account (or any part thereof) or use of INQUIZIE and remove and discard your content for any reason at any time and you hereby agree that INQUIZIE shall not be liable to you or any third-party for any termination of your service, access and or loss of your content.

California Civil Code Section 1789.3 provides that users of the Service from California are entitled to rights under The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs which may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210. YOU EXPRESSLY UNDERSTAND AND AGREE THAT INQUIZIE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF INQUIZIE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, RESULTING FROM: (I) THE USE OR THE INABILITY TO USE THE SERVICE; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (IV) STATEMENTS OR CONDUCT OF ANY THIRD-PARTY ON THE SERVICE; OR (V) ANY OTHER MATTER RELATING TO THE SERVICE. IN NO EVENT WILL INQUIZIE'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID INQUIZIE IN THE LAST SIX (6) MONTHS, OR, IF GREATER, ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS SET FORTH ABOVE MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SERVICE OR WITH THESE TERMS OF SERVICE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICE.
